1. Vetting Business Plans and Cash Flows
The Receiver must assess and determine the profitability, cash flow, short-term financing options, asset security, internal controls, and operational performance of the business as soon as possible. Moreover, the Receiver needs to determine whether the existing management team is capable of executing the business plan and concurrently dealing with the bankruptcy process. 2. Interim Management
We provide interim management roles for the Receiver or Trustee including:
- CRO – a role specific to managing the restructuring activities
- CEO/COO – in some cases we have been called on perform certain interim operating management duties
- CFO – in many cases the company has lost their top financial officer or the added burden of the insolvency has overloaded existing management
3. Cash Collateral Usage Agreements
Kibel Green assists the Receiver in assessing and negotiating the terms of the use of cash collateral. The Receiver may not be able to procure financing or arrange terms with a lender that are acceptable to the Debtor and the Creditors of the estate. Under these conditions, it may be necessary to seek approval for the usage of cash collateral which includes an assessment of the lender's collateral position and the assurance of adequate protection.
4.Lease Renegotiations
A key driver in successfully reorganizing is the appropriate restructuring of the Debtor's obligations. Kibel Green can assist the Receiver in restructuring lease arrangements to lower the cost of occupancy to a level that enables profitable operations.
5. Litigation Support
At times during the course of the bankruptcy process, it may be necessary for the debtor to make motions to the court for approval of certain activities. Whether on issues of adequate protection or on other matters, Kibel Green provides litigation support to advance the interests of the estate.
6. Claims Analysis & Claims Management
We assist in all facets of claims analysis and management and help the estate address creditor demands. One key to a successful bankruptcy proceeding is effectively evaluating and negotiating the pre-petition claims of the debtor including things such as wage claims, reclamation claims and general unsecured creditor claims.
Our team knows the intricacies of how claims fall into different classes for payment priority under a Liquidation versus a Plan of Reorganization and includes the recovery of preferred claims by the estate as part of the analysis.
